GILLICK COMPETENCE


GILLICK COMPETENCE – See also Fraser Competence

A term used in English medical law to describe the ruling made by the House of Lords relating to the rights of children under the age of 16 to consent to medical treatment without their parent's knowledge. Subsequently should a Doctor decide that a child is 'Gillick Competent'* then they can only disclose information to the parent with the child's consent, regardless of Parental Responsibility.

*The term Fraser Competence (after Lord Fraser who made the ruling) is preferred to Gillick Competence.
